The NXTASTE digital platform (hereinafter the "Platform") accessible via the website www.nxtaste.com (hereinafter the "Site") or the mobile application "NXTASTE" (hereinafter "the Application") developed by the company Y2G (hereinafter referred to as "NXTASTE") allows consumer users (hereinafter the "Users") via the Platform to order dishes, products, meals, or take-out menus online (hereinafter the “Service”) with independent professional service providers specialized in the field of food trade (restaurants, pastry chefs, grocers, etc.) referenced on the Platform (the “Partners”).

As part of their use of this Platform, the User and the Partner are required to transmit personal data concerning them.

We attach the greatest importance to the confidentiality of your information and your personal data. This privacy policy has been founded in compliance with the laws, regulations and standards in force and explains what personal data is processed by the Platform, how it is processed, by whom and for what purposes.

This Privacy Policy is therefore intended to apply to any person using the Service. The content and data of some of our Services are also available to simple browser users (“Visitors”).

1. Collection of personal data:

The personal data collected via the Platform are as follows:

Account opening: When creating the User or Partner account, NXTASTE collects their surname, first name, email address and telephone number.

Connection: When the User or Partner connects to the Platform, the latter records in particular his surname, first name, connection data, usage data, location data and payment data.

Payment: as part of the payment for the service offered on the Platform, the latter records financial data relating to the User's and/or Partner's bank account or credit card.

Communication: When the Platform is used to communicate between User and Partner or with NXTASTE, the data concerning the communications are the subject of a temporary conversation.

Cookies: Cookies are used as part of the use of the Site. The Partner has the option of disabling cookies from their browser settings.

2. Use of personal data.

The personal data collected from Users and Partners is intended to provide the Platform Service, improve it and maintain a secure environment. More particularly, the uses are as follows:

Access and use of the Platform by the User and the Partner,

Management of the operation and optimization of the Platform,

Verification, identification and authentication of the data transmitted by the User and the Partner,

Communication with NXTASTE or between Users and Partners of the Platform,

Implementation of User and Partner assistance,

Customization of services by displaying advertisements based on the User's browsing history, according to their preferences,

Prevention and detection of fraud, malware (malicious software or malicious software) and management of security incidents,

Management of any disputes between the Parties,

Sending commercial and advertising information when the Users or the Partner have accepted it.

3. Sharing of personal data between Users and Partners:

4. Sharing of Users' and Partners' personal data with NXTASTE subcontractors and third-party companies:

The personal data of the User and the Partner may be shared with NXTASTE subcontractors and third-party companies, in the following cases:

When the User and the Partner use the financial services offered by STRIPE via the Platform, STRIPE also being in contact with third-party banking and financial companies,

When NXTASTE uses the services of service providers to provide assistance, advertising, payment services or hosting. These service providers have limited access to the data, in

If NXTASTE is involved in a merger, acquisition, sale of assets or receivership procedure, it may be required to sell or share all or part of its assets, including personal data. In this case, Users and Partners would be informed, before the personal data is transferred to a third party.

In addition, Users and Partners acknowledge that NXTASTE may transmit the personal data provided by Users and Partners to third parties for the sale of market research as soon as they are anonymized.

5. Shelf life

Personal data is kept only for the time necessary to fulfill the purposes mentioned above or to allow NXTASTE to meet its legal obligations.

Personal data used for commercial prospecting purposes may be kept for a maximum of three (3) years from the end of the commercial relationship.

6. Transfer of personal data abroad:

NXTASTE informs the User and the Partner that no transfer of personal data has taken place to date. The data processed is hosted in France or in the European economic zone. In any case, NXTASTE undertakes to comply with the legal provisions regarding the transfer of personal data abroad and in particular any "Private Shield" policy, and therefore undertakes to inform the User and the Partner.

7. Security and confidentiality:

NXTASTE implements organizational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorized access. However, it should be noted that the Internet is not a completely secure environment and the Platform cannot guarantee the security of the transmission or storage of information on the Internet.

8. Implementation of User rights:

In application of the regulations applicable to personal data, Users and Partners have the following rights:

They can delete their account, by writing to the following email address support@nxtaste.com. It should be noted that information shared with other Users, such as posts on forums, may remain visible to the public on the Platform even after the deletion of their account,

They can exercise their right of access to know the personal data concerning them, by writing to the email address: support@nxtaste.com. In this case, before the implementation of this right, NXTASTE may request proof of the User's identity in order to verify its accuracy,

If the personal data held by NXTASTE is inaccurate, they may request that the information be updated by writing to the email address support@nxtaste.com,

Users may request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the email address support@nxtaste.com.

9. Evolution of the personal data protection policy:

NXTASTE reserves the right to make any changes to this Privacy Policy at any time. If a modification is made to this Privacy Policy, NXTASTE undertakes to publish the new version on its Site or its Application. NXTASTE will also inform the Users/Partners of the modification by e-mail, within a minimum period of fifteen (15) days before the effective date. If the User or the Partner does not agree with the terms of the new wording of the Privacy Policy, he has the option of deleting his account.
